This End User License Agreement (this “EULA”) governs your use of the Roomie mobile app (the “App”), provided by Company ERM AL-HADITH For Information Technology (One Partner) (“Roomie”, “we”, “us”). It applies in addition to our Terms of Service, which govern your use of the Roomie service generally. If anything in this EULA conflicts with the Terms about your use of the service, the Terms govern — except on app-store-specific matters, which are covered below.
By downloading or using the App, you agree to this EULA.
License grant
We grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on a device that you own or control, solely for your personal, non-commercial use. This license is subject to this EULA, to our Terms of Service, and to the usage rules of the app store you downloaded the App from.
Restrictions
You may not:
- copy, modify, adapt, translate, or create derivative works of the App;
- reverse-engineer, decompile, or disassemble the App, or try to derive its source code, except to the extent this restriction is prohibited by applicable law or permitted by the relevant app store’s terms;
- rent, lease, lend, sell, redistribute, or sublicense the App; or
- use the App in any way that breaks our Terms of Service or Community Guidelines.
App store terms
Your use of the App is also subject to the standard terms of the app store you downloaded it from — Apple’s Licensed Application End User License Agreement for the Apple App Store, and Google Play’s Terms of Service for Google Play. If those store terms conflict with this EULA on a matter specific to that platform, the store terms govern for that platform.
Additional terms for the Apple App Store
If you downloaded the App from the Apple App Store, the following also apply. In this section, “Apple” means Apple Inc.
- This EULA is with us, not Apple. This EULA is concluded between you and us only, and not with Apple. Apple is not responsible for the App or its content.
- Scope of license. The license granted to you is a non-transferable license to use the App on any Apple-branded device that you own or control, as permitted by the Usage Rules set out in the Apple App Store terms.
- Maintenance and support. We are solely responsible for providing any maintenance and support for the App, which you can request at support@roomie.cc. Apple has no obligation to provide any maintenance or support services for the App.
- Warranty. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price of the App to you (if any). To the maximum extent permitted by applicable law, Apple has no other warranty obligation for the App, and any other claims, losses, liabilities, damages, costs, or expenses arising from a failure to conform to any warranty are our sole responsibility.
- Product claims. We, not Apple, are responsible for addressing any claims by you or any third party relating to the App or your possession or use of it, including (i) product-liability claims; (ii) any claim that the App fails to meet any applicable legal or regulatory requirement; and (iii) claims arising under consumer-protection, privacy, or similar laws.
- Intellectual-property claims. If a third party claims that the App, or your possession and use of it, infringes that party’s intellectual-property rights, we — not Apple — are responsible for the investigation, defense, settlement, and discharge of that claim.
- Legal compliance. You represent and warrant that (a) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist-supporting” country; and (b) you are not listed on any U.S. Government list of prohibited or restricted parties.
- Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of this EULA, and upon your acceptance of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary.
Termination
This license ends automatically if you breach this EULA or our Terms of Service. When it ends, you must stop using the App and delete it from your devices. Our Terms of Service explain suspension and termination of your account more fully.
Disclaimer and liability
The App is provided “as is” and “as available.” The disclaimers and limitation of liability set out in our Terms of Service apply equally to the App; please read them there.
Governing law
This EULA is governed by the laws of the Kingdom of Saudi Arabia, consistent with our Terms of Service. Any dispute is handled as set out in the Terms.
